No on is saying that, just that the impact of the fine is much different for people that make different amounts of money. Therefore the punishment has different impacts and the punishment is less (in actual impact to the person) for the person who is rich.

That make perfect sense to me.
In my example these guys were on a non-guided drop-off hunt for moose and caribou. They were warned by their bushpilot when dropped off to not stray far from camp as they WILL get their animals right at camp and that it is a major chore to pack them. The guys were all in their 60's and not fit for doing much packing. As you may have guessed, the group all shot trophy bulls miles from camp. The pilot dropped in to check on them midway through thier hunt and saw the pile of racks at camp and no meat. He warned them to go and pack their meat out. The hunters all said "there ain't no way in hell we are going back after the meat. Just packing the antlers out about killed us." 1st off, that is already illegal in Ak. Antlers must remain at the kill site until all the meat is salvaged. The hunters went on to tell the pilot he might as well turn them in now and just let them know what the fine will be as they will all gladly pay up!!! Most of us cannot afford to glady "payup" a $10.000+ fine for a blatant act or certianly would not do so "gladly". In this case, the jail time imo is/was the right deterrant to these fine gentlemen.

I do not agree with the idea of a ticket for speeding 10 over should cost different for different income levels. It is only when money is no longer an object to the offender and it is not deterrant from keeping them from their actions.

i dont mind the graduated fine system based on income, ends up being all relative doesnt it?

a $250 ticket for say 15 over wont make a dent in a rich mans pocket, while it may break the guy whos scrambling to pay the rent....

that being said, i'd always drive as fast as i could afford to...

speeding is a grey area anyways, everyone does it..

Isn't that statement contradictory? You say that it shouldn't cost different for different income levels, until for people where money is no longer an object?

Ollie had it right, so did the judge with the hunters.

The punishment shall fit the crime. There are almost always choices that can be made by the judge between jail time and fines or a combination of the two.

Just as the amount of the fine has a profoundly different affect on the poor guy vs the rich guy, the inverse is true of the jail time. The poor guy isn't missing much by being in jail, the rich guy is likely taking a serious beating by being jailed a month, or two or three.

If time = money, isn't this the same thing as charging rich people more (larger fine) then poor people? Monetarily, would there be any difference in your above comment by just fining the poor guy less and the rich guy more? It doesn't seem like there is a difference to me.

So if a poor man commits murder he should pay a small fine and spend a few months in jail, but a rich guy should get the death penalty?

A line has to be drawn, yes... but that comparison's a bit of a stretch.
