I don't think there really is a "better or worse" privacy code due to whether or not they broadcast at a higher or lower frequency, they're all in a similar bandwidth ....

There are precisely 11 billion people who transmit on channel 4 CTCSS code 20 though. Go figure.

So if you actually want to talk to people in your group, don't use that one

"Part 90" = commercial, licensed radio service. License/lease required here.

"Part 95" = unlicensed stuff, this is your CB radios, FRS/GMRS, MURS stuff. Low-power, local-only kind of operations.
"Part 97" = 'ham radio', amateur service. License required.


Those baofengs are capable of transmitting on spectrum allocated to parts of all of those services, right out of the box. That's a big no-no.
They're not type-accepted for unlicensed operation, again, not legally allowed on those FRS/GMRS frequencies because of that.


They're ham radios that are capable of transmitting all over places they shouldn't transmit.


And the people buying them don't usually understand that.


Also, they're shitty radios. The receivers are deaf, the transmitters are underpowered. They're $30 for a reason.
Not to mention they're complicated because of the fact they're "ham radios", not really intended for general-consumer use.


I'm glad to see FCC doing something about it, these have been a problem for commercial/public-safety users for years now.

Also, the "license by rule" they mention in the article isn't really true, the way they word it.

FRS/GMRS is unlicensed operation, no license required. GMRS does give you the option of acquiring a license ($70, 10years) that grants you permission to use higher power output and repeaters where they exist (or set one up, if you want).


"License by rule" is what I fall under with public safety radios. I'm operating on leased frequencies for public safety. I'm not a license-holder on those frequencies, but because i'm acting in public-safety duties and interests, I'm granted a "license-by-rule" to operate on those bands. Firefighters, cops, medics all fall under the same thing.
